I don't think its stupid. Performance enhancing drugs are a significant performance factor. I believe the best way to handle the difference is voluntary declaration backed up by social ostracism and the profit-loss mechanism. Relative performance drug free versus relative performance using banned substances is the issue, not absolute results.

If we had tested and non tested divisions we would still have people clean out and lift in tested division. (powerlifting)

Sure, if you make a law against fraud, there will still be people who commit fraud. I say punish those guilty of the fraud through a judicial process rather than just punishing everyone ahead of time. Authoritarianism really is the opposite of good sportsmanship.
