Jack,

I hope that is the case but I don't think so. I expect they will break our deal saying the USOC won't approve it and insist on another 6 months of ineligibility which will cost me the chance to lift at the 09 Sr Nationals. They are just trying to punish me for their mistakes and for resisting that punishment. I do think it will make a very strong case for me to sue them if they do break our deal and don't allow me to lift at nationals however.

Got this from USADA today. One point of contention in the letter, the USAW lawyer did not tell me at the time we made the deal that it would have to be approved by the USOC. First I heard that was just a few weeks ago.

It is unbelievable to me, but the USOC has refused to honor the deal that USADA, through their chief lawyer, made with me. I made that deal over a year ago and have been waiting til now for them to make it happen. And now they refuse to honor it. So, I can't lift at Sr Nationals. Since the USADA program is now so onerous, since I don't care about any meet except the Sr Nationals, since I can't compete in a meet I care about until the 2010 Sr Nationals, I guess I am going to retire. Perhaps I will come out of retirement again before then but I will decide that much later. I am bitter and very angry.

so now even if you did wait 6 months would it be too late to qualify for nationals?

Yes, by the time my 6 month "waiting period" would be over it would be too late to qualify for Sr Nationals. Right now, I have only completed 34 days of it according to them though they have had me ineligible now for like 16 months and the last year we had an agreement for 3 months that they never delivered and then refused to honor.

That is really stupid. There just isn't any reason for them to make this into a big deal.

They are just retaliating against me for pointing out that they broke their own rules.
